88Vacation is a digital platform that helps users discover, compare, and book vacation stays, experiences, and related travel services ("Listings"). Unless explicitly stated otherwise, 88Vacation does not own, manage, or control the properties or services listed on the platform. Each host, partner, or provider ("Provider") is solely responsible for the accuracy of their Listing, the quality of their service, and compliance with applicable laws.
We may update, modify, or discontinue any part of the Services at any time, with or without notice, provided that such changes do not materially and adversely affect existing confirmed bookings without appropriate remedies.
3.1 Bookings. When you make a booking through 88Vacation, you agree to be bound by the terms and conditions of the relevant Provider, including any house rules, cancellation policies, and additional fees disclosed at the time of booking. A legally binding agreement is formed between you and the Provider when your booking is confirmed via the Services.
3.2 Pricing and Fees. Prices displayed through the Services may include taxes, cleaning fees, service charges, and other applicable fees, or such amounts may be itemized during the checkout process. 88Vacation may charge a service fee for facilitating the booking, which will be disclosed before you complete your purchase.
3.3 Payments. You authorize 88Vacation and our third‑party payment processors to charge the payment method you provide for all amounts due in connection with a booking, including security deposits where applicable. You represent and warrant that you are authorized to use the payment method provided and that all payment information is accurate and complete.
3.4 Cancellations and Refunds. Cancellation terms vary by Listing and are presented to you before you confirm your booking. Your eligibility for refunds is determined by the applicable cancellation policy and by any mandatory consumer rights that may apply. 88Vacation may, but is not obligated to, assist in dispute resolution between you and a Provider.
You agree to use the Services in compliance with all applicable laws and regulations, and to respect the rights of Providers, other guests, and third parties. You agree that you will not:
5.1 Your Content. You may submit reviews, photos, profile information, and other content ("User Content"). By submitting User Content, you grant 88Vacation a worldwide, non‑exclusive, royalty‑free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating, marketing, and improving the Services. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not infringe any third‑party rights.
5.2 88Vacation Content. The Services and all content made available by 88Vacation, including software, designs, text, graphics, logos, and trademarks ("88Vacation Content"), are owned by or licensed to 88Vacation and are protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Services or 88Vacation Content, nor may you reverse engineer or attempt to extract the source code of any software, unless laws prohibit these restrictions or you have our written permission.
Your use of the Services is also subject to the 88Vacation Privacy Policy, which explains how we collect, use, and share your personal information. By using the Services, you acknowledge that you have reviewed our Privacy Policy and consent to our data practices as described therein.
To the maximum extent permitted by law, the Services and all Listings are provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory. 88Vacation specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and non‑infringement, and any warranties arising out of course of dealing or usage of trade.
88Vacation does not endorse, guarantee, or assume responsibility for any Listing, Provider, guest, or third‑party service. We do not control and are not responsible for the conduct of users or Providers, and you use the Services at your own risk.
To the maximum extent permitted by law, 88Vacation and its affiliates, officers, directors, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Services or any Listing, even if we have been advised of the possibility of such damages.
In no event will the total liability of 88Vacation for all claims relating to the Services exceed the greater of (a) the amounts you have paid to 88Vacation in connection with your use of the Services during the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100) or equivalent in local currency.
You agree to indemnify, defend, and hold harmless 88Vacation and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with (a) your access to or use of the Services, (b) your User Content, (c) your interaction with any Provider or other user, (d) your breach of these Terms, or (e) your violation of any law or the rights of any third party.
We may suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including if we reasonably believe that (a) you have violated these Terms or applicable law, (b) you pose a risk or possible legal exposure to 88Vacation, Providers, or other users, or (c) your account has been inactive for an extended period. Where appropriate, we will provide you with notice of termination or suspension.
Upon termination, your right to use the Services will immediately cease, but provisions that by their nature should survive (including ownership provisions, warranty disclaimers, limitations of liability, and indemnity) will remain in effect.
These Terms and any dispute arising out of or in connection with them or the Services will be governed by and construed in accordance with the laws of the jurisdiction in which 88Vacation is incorporated, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You agree to first attempt to resolve any dispute with 88Vacation informally by contacting us using the details provided below. If we cannot resolve the dispute within a reasonable time, the dispute will be submitted to the exclusive jurisdiction of the courts located in our principal place of business, unless mandatory consumer protection laws provide otherwise.
We may modify these Terms from time to time to reflect changes in our Services, business practices, or legal requirements. When we do, we will post the updated Terms on the Services and revise the "Last updated" date at the top of this page. If the changes are material, we may also provide you with additional notice, such as by email or in‑app notification. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
13.1 Entire Agreement. These Terms, together with any additional policies or terms referenced herein (including our Privacy Policy), constitute the entire agreement between you and 88Vacation regarding your use of the Services and supersede any prior agreements or understandings, whether written or oral.
13.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
13.3 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms, in whole or in part, without restriction.
13.4 No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Message and data rates may apply. You are responsible for any fees charged by your carrier for receiving SMS messages.
To opt out, reply STOP to any SMS message from 88Vacation or follow the opt-out link provided in the message. After opting out you may still receive messages related to outstanding transactions or as required by law.
88Vacation is not liable for delayed or undelivered messages; carriers are responsible for message transmission. 88Vacation is not responsible for carrier fees, service outages, or routing issues.
